Consumer Debt Attorneys Serving Texas

It is a very frightening reality that many hardworking Americans face unexpected financial issues that can lead to them falling into heavy consumer debt. From losing their job to dealing with serious medical conditions that can lead to thousands of dollars in credit card debt, individuals from all walks of life dealing with consumer debt can face devastating effects to their financial and mental wellbeing.

In the United States, as of December 2018, consumer debt rose to $3.01 trillion.

Unfortunately, many good people face unexpected financial hardships and have difficulty seeing the light at the end of the tunnel. But there is hope and you do have options.

Our Consumer Debt Practice Areas

Consumer debt, also known as consumer credit, is what we owe when we borrow from a bank, credit union, business, or the federal government. Generally speaking, consumer debt is carried by an individual for personal, family, or household expenses.

Scare Tactics Debt Collectors Use

When you are buried in debt, your creditors may begin to use debt collection agencies to seek payment. Unfortunately, debt collectors can be unrelenting and may even use lies, scare tactics, or threats to get you into paying. Most collection agencies are paid on a commission which is why they can get extremely pushy.

Being aware of the scare tactics and deceitful practices they use can help you to better protect yourself and avoid being taken advantage of. Some of the most common scare tactics include:

  • Constant Calling: Debt collectors may call at all hours of the day, call family members, or even attempt to reach you at work. You do NOT have to answer and you can even send a letter to the debt collector to stop calling you – just make sure to keep a copy for your own records.
  • Wage Garnishment Threats: Debt collectors cannot garnish your wages without a court order from a judge. Without going through the correct legal processes, the debt collectors have no way to garnish your wages.
  • Deadlines: The debt collectors may try to convince you that you must pay off your debts within a certain timeframe unless you may be liable for additional fees or legal ramifications. This is a scare tactic used to coerce you into paying.
  • Improved Credit Score: Paying your debt off immediately will not automatically improve your credit score at once. Do not be fooled by debt collectors who make these types of promises.
  • Threatening to Make Your Information Public: Debt collectors are NOT allowed to publicly share information about your financial situation. They may warn you that they are going to share this information with family or your employer but you are protected against this by the Fair Debt Collection Practices Act.

You deserve to be treated fairly. The Texas consumer debt lawyers at The Kherkher Law Firm PLLC are ready to defend your rights.

When to Hire a Lawyer

The first step you’ll want to take when dealing with consumer debt is to attempt to fix the situation on your own. This means correcting your financial situation through proper budgeting and limited spending. If necessary, you can contact a nonprofit credit counseling service to help guide you towards making the proper adjustments.

Should your financial situation expand beyond your control, and you are threatened with legal action against you, then it may be necessary to reach out to a qualified consumer debt lawyer. Some signs that you need to seek out legal guidance include:

  • You have attempted to correct the situation with the assistance of a debt counselor and are still unable to repay your debt.
  • A creditor has filed a lawsuit against you.
  • Your car has been repossessed.
  • The creditor has been illegally harassing you.
  • The statute of limitations has passed for the creditor to collect the debt.
  • The creditor filed the case in the wrong court or failed to produce adequate documentation.

Talk with a law firm willing to provide you a free consultation prior to retaining them. This way, they can give you an honest analysis of how likely your chances are for winning your case. It might be worth the cost to retain a lawyer if you have a legitimate chance of defending yourself, have a sizeable debt issue, and can’t handle the legal dealings on your own.

Ask the credit counselor, friends, family, or financial professionals if they have any lawyers they recommend. You can also research online for a quality lawyer in good standing. The individual should be honest and upfront; spending money on a lawyer if you have a very low chance of defending yourself can be a waste of resources if you are already having financial problems.

The Debt Collection Lawsuit Process

In order to lawfully collect a debt, creditors or debt collectors must file a lawsuit. If you do not properly respond within the deadline assigned to your case, you are likely to have a judgment against you, which means you essentially run out of options to settle your debt.

This can lead to your creditor garnishing your wages, a lien on your personal property, or a sizable amount of money being taken from your checking or savings account. Your debt may continue to collect interest as well.

Most consumer debt lawsuits observe the following process:

  • Original Petition: A petition is filed with the court to begin the process of securing the debt owed. The petition and a citation are “served” to the responsible party. This begins the lawsuit process.
  • Original Answer: You must respond to the citation in writing or a default judgment will be set against you. Your response should include a denial of the allegations, a list of defenses, and should be signed and submitted to the court, as well as to the opposing attorney. A response is absolutely essential as failure to do so means you lose out on the right to defend yourself.
  • Discovery Period: During the discovery period, both parties are allowed to investigate the lawsuit using a number of tools such as depositions, interrogatories, request for admissions, and more. The court sets the discovery period time frame.
  • Summary Judgment: A “Motion for Summary Judgment” is generally filed by one party to request that the court decide the lawsuit with a motion rather than a trial. The judgment can be decided with or without a hearing.
  • Trial: There is generally an attempt to settle the lawsuit through mediation but if this is not possible, then the next step is to take it to court. These types of lawsuits are decided by the judge (no jury) with both sides providing evidence. The judge alone will decide whether or not you are liable for the debt.

While this overview simplifies the process, the truth is that it can be very complex to navigate your way through a consumer debt lawsuit alone. That is why it is absolutely important that you seek the guidance of a qualified attorney to ensure you are properly defended against any allegations against you.
